Member Registration

You are responsible for providing at registration/sign in true, current and complete information about yourself. Also, you will be responsible for maintaining and updating registration information and adhering to the aforementioned statement regarding your personal data. If you provide untrue, not current or incomplete information or Netyab.com believes that information you provided is untrue etc..., Netyab.com reserves the right to suspend or terminate your account without prior notification. Also Netyab.com is not obligated to provide you with our services.

Parental Consent and Supervision of their minors

At Netyab.com, we are concerned about the safety and privacy of all our users. However, in compliance with the law, Netyab.com has implemented a procedure whereby the parent must give consent for their child under the age of thirteen. For those under the age of 13, you are prohibited from using Netyab.com until we have parental consent on file. However, Netyab.com recognizes that it is the responsibility of the parent/legal guardian to monitor and supervise their child while using Netyab.com. Netyab.com will not be responsible and/or liable to a parent and/or child under the age of 18 who enters our chat site. The person responsible for the child must be the legal guardian of the child. The legal guardian is responsible for determining whether any of the Services and/or Content are appropriate for your child/teen.

Use of Service Termination

Netyab.com reserves the right to terminate the user's service at any time without notification. This means Netyab.com may discontinue the user's password, nickname and information from the database if the user has not used the service in 6 months. Netyab.com is not responsible or liable, if for any reason, the service is interrupted, the user is not satisfied with the service, and/or access is denied for any reason. Netyab.com, also, reserves the right to cancel the user's membership for violation of the Terms of service at any time without prior notification.

Security, Password, and Account Information

When you register with Netyab.com, you either have chosen your own password, or have been assigned a password. Also, you are given options on what you want available to the public via your profile page. You are responsible/liable for the confidentiality of your password and information of any kind regardless of the environment ( i.e. if you carelessly divulge information or your password to the public, you are responsible for that and Netyab.com will not be held liable.) While using Netyab.com, if you divulge information of any kind in any form that would affect you in such a way that damages or losses are incurred to you, Netyab.com is not responsible or liable to you. While you are using Netyab.com services, you are responsible and liable for any activities that occur while using our services. You agree to inform Netyab.com of any unauthorized use of your account. Netyab.com will not be liable for any losses or damages incurred as a result of you not adhering to the aforementioned security issues.

Sharing Account

Netyab.com prohibits the sharing of accounts. You may be held liable to Netyab.com and other user(s) for losses or damages because someone else uses your account.

Code of Conduct

You understand and agree that you are responsible and liable for any information in any form (i.e. data, text, software etc...) that you transmit, taking into account the various ways of inputting information for reception using Netyab.com, whether it be privately and/or publicly. You are responsible and liable if any local, state, or federal laws are broken as a result of your transmissions or behavior. Also, you will be held liable to any one including Netyab.com who incurs damages and/or losses as a result of the content you transmit or your behavior whether it be privately or publicly. Netyab.com will not be held liable for your conduct while using our services. Netyab.com will not be held liable for any damages and/or losses that you incur as a result of a transmission of any information in any form or another user's behavior. Netyab.com does not control the content posted via the Service. We do not guarantee the validity, integrity or quality of the content. You understand and agree not to hold Netyab.com liable for any content that you find offensive, adult in content, and/or unreasonable. Netyab.com will not be liable in any way for any content, including, but not limited to, e-mails from other users, integrity, validity, reliability, and/or quality of any content in any form, any losses or damages of any kind while using our services.
Netyab.com prohibits the below mentioned conduct. You are responsible and liable for damages and/or losses if your behavior while using Netyab.com violates the below prohibitions. Netyab.com provides a service, we do not have control over a user's behavior or content transmitted by users. Netyab.com will not be liable in any way for losses or damages incurred while using our service.

1. While the safety of all our users is paramount to Netyab.com, we prohibit and have no tolerance for any harm to minors.

2. At Netyab.com we offer a venue to post personal information if the user chooses to; however, we prohibit and the user is held liable for any actions or words while using Netyab.com product and services that will bring harm to another individual user. Harm is defined at Netyab.com in very general terms and is not limited to defamation, vulgar or obscene language, invasion of another's privacy, racial, ethnic remarks, harassment, threatening and abusive behavior. In other words, actions or words taken that creates a hostile environment to a user is prohibited and the user perpetrating the actions or words is held liable for damages, losses or injury.

3. Netyab.com cannot control the actions or words of others. We are not liable for damages, any losses and/or injury to you from using our services.

4. The user will agree to manage their interaction with other users on Netyab.com in a positive format. Typing multiple large posts or running the scroll bar faster than normal is a form of disruption to the normal flow of dialogue in a real time setting. This type of action is prohibited.

5. The user will not disrupt or interfere with Netyab.com service in any form. This means that disrupting/interfering with the server, users, and third party advertisement is something we take very seriously. The user will not in any form disrupt/interrupt services with material that contains software viruses, and/or booter codes, programs.

6. All users are responsible and liable for their own actions in regards to the law. Netyab.com will not be responsible or liable for any type of illegal activity at the local, state, federal or international levels performed by a user. If you intentionally or unintentionally perform/promote an illegal activity using Netyab.com, the user (you) are liable. Netyab.com will fully comply with the law in having such a user prosecuted.

7. You will agree to the policy that Netyab.com has concerning personal information of other users utilizing our services. You cannot use posts, voice, web cams and profiles as a way to collect and store data about our users. Our users are simply that, our users. The information will remain within the Netyab.com environment. The user's posts, voice, web cam, profiles cannot be used to further a business, or write a book and not limited to the aforementioned unless in those instances when law enforcement need access to the information. Netyab.com reserves the right to handle and disclose material that could be used to comply with law enforcement or to protect the rights of others and Netyab.com.

8. You agree not to restrict another user from using Netyab.com Services. This means that a user does not have the right to block and/or tell other users to leave. The ignore functionality of the chat room is designed for users to ignore people with whom they do not want to interact with.

9. Telling users that you are a Netyab.com employee is against our policy. If someone is impersonating any person or entity, including, but not limited to, a Netyab.com employee, they are acting against the policy of Netyab.com.

10. You are responsible for revealing any information in any form that you do not have the right for. This type of exposure is prohibited.

11. You agree not to engage in advertisement of any sort using Netyab.com.

12. You agree not to violate any laws including but not limited to trade marks, proprietary information, copy rights.

You must acknowledge and agree to the aforementioned prohibitions. Netyab.com reserves the right to enforce, change, and/or update the TOS at any time and without notification. Netyab.com will respond to any complaints regarding your activity on our website.

Third Party Advertisers

Netyab.com will not be held responsible or liable for damages or loss to the Netyab.com user who conducts business transactions between Third Party Advertisers and themselves.

Proprietary Rights of Netyab.com

You may in no way infringe upon the rights of Netyab.com with regard to our website, logos, and/or Software. A user who violates any proprietary law or confidentiality is subject to liability. The software that we use will not be replicated, reengineered, and/or altered in any form. With regard to Netyab.com third party advertisers, the user will abide by third party advertiser's terms and conditions. Netyab.com will not be held liable for user violation of third party advertisers.

User Copy Rights

You will respect the copy rights of others within the Netyab.com environment. Netyab.com will not be responsible or liable for infringement of copyrights by Netyab.com users.

Netyab.com Trademark

Use of Netyab.com logos, brands etc... will be prohibited where it undermines the value of our good business name. Use of Netyab.com logos, brands, etc... by any one does not directly or indirectly mean an endorsement of that product or service by Netyab.com.

Terms of Use Update (s)

Netyab.com reserves the right to change/update the Terms of service, and notices under which the Netyab.com services are offered, including but not limited to the charges associated with the use of the Netyab.com sites/services. You are responsible for regularly reviewing these Terms of Service and Privacy Policy. Your continued use of the Netyab.com Sites/Services constitutes your agreement to all such terms, conditions, and notices.

Photos

1. Netyab.com allows users to show images, photographs, pictures that are graphical in nature on the user profile page. However, anything adult and/or offensive is prohibited. The user shows their form of graphic at their own risk.
2. If Netyab.com comes across something that we determine as adult content and/or offensive, we garner the absolute right to discontinue your account without prior notification. Also, if another user comes across something that they determine as adult content and/or offensive, Netyab.com is not responsible and/or liable for the adult content and/or offensive form of graphics. The user is responsible and/or liable for the form of graphics that the user shows on their profile page.
3. Netyab.com will not be held liable for any misuse, misrepresentation of and/or copyright violations regarding any form of graphics. It is the sole responsibility/liability of the user to abide by copyright laws for any form of graphics the user shows on their profile page. If the user shows a form of graphics that would require permission of the owner, then they would need to get the owners permission before submitting or the user will be held liable.
4. Netyab.com will not be responsible and/or liable for how another user may use Netyab.com services. If another user, but not limited to, distributes, copies, prints, alters, a user's profile form of graphic, Netyab.com will not be held liable for any damages incurred. You will agree to give Netyab.com permission to show your form of graphic for public viewing, but (you) the user will be liable for its content and for abiding by any state, local, and federal laws regarding copyrights, pornography and anything mentioned above regarding liability.
5. If your form of graphic (i.e. picture etc...) is used by another user for a profit, Netyab.com is not liable to compensate you in any way.

 Spamming

Spamming in any form is prohibited. Spammers are responsible for any damages incurred to Netyab.com and/or others as the result of spamming. If the user finds himself/herself spammed, you are responsible to the Netyab.com user. Netyab.com will not be held liable for any spamming that you perform while using our services. If we determine at our sole discretion that you are involved in spamming activities, Netyab.com reserves the right to terminate your account without prior notification.

Links

Netyab.com will not be held liable or responsible for any link that points to a website other than the Netyab.com domain.

Indemnity

You agree to indemnify and hold Netyab.com, and its employees and business associates, harmless from any claim or demand including but not limited to, all attorney fees that are made by another user/third party. You will be liable to another user/third party for a claim or demand, and all attorney fees but not limited to that for your conduct while using our services. The avenues through which a claim or demand could be brought to the forefront and you would be liable for are the following:

1. Content that you submit in the Netyab.com chat environment.
2. Violation of the Terms of Service and Privacy Policy.
3. Violation of the rights of others as mandated under local, state, and federal laws.
4. The third party may bring other claims, or demands forward that are not mentioned in 1,2,or 3. If this will be the case, Netyab.com will not be liable for your misuse of our services in any form that a third party advances to legal proceedings or by contacting us directly. Netyab.com reserves the right to discontinue service of a user at any time without notification for reasons we deem necessary.

Exclusions and Limitations

If for any reason Netyab.com is found liable, you agree that the maximum aggregated liability will not exceed 10 (ten) USD.

Warranties

You understand completely and agree to that:

1. Netyab.com provides a service, but the use of our service by you is completely at your own sole risk. We provide our services to you on an "as is" and "as available" basis.
2. Netyab.com disclaims all warranties of any form.
3. Netyab.com makes no warranty that:
   • Our software malfunctions will be corrected.
   • Our services will meet your requirements.
   • The quality of services, products, information, or materials purchased or obtained by you through Netyab.com will meet your expectations.
   • The service will be valid or reliable with regard to the results.
   • The service will not be interrupted, timely, secure or error-free.
4. You, the user who downloads or obtains any material using our services will do so at your sole discretion and risk. If you incur damages to your computer or your data is lost as a result of downloading and/or using our services, Netyab.com is not responsible/liable.
5. Netyab.com does not warranty the advice given to you in written or oral form whether it is from Netyab.com and/or while using our services. However, any warranty that is expressly stated in our terms of service shall apply.

You understand completely and agree that Netyab.com will not be held liable for any kind of damages or losses regarding any matter relating to our services.
